WESTFIELD ICE RINK AND WESTFIELD CHRISTMAS GROTTO
TERMS AND CONDITIONS

Please read these Terms and Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Westfield Shoppingtowns Limited (“Westfield”) makes the Westfield Ice Rink and the Westfield Christmas Grotto available for use.

1    Tickets
All tickets are issued subject to availability and to these Terms and Conditions. Purchasing tickets is acceptance by you of these Terms and Conditions.
A valid Ice Rink ticket must be produced by you for each member of your party in order to gain admission to the Westfield Ice Rink. Removing any part of, altering or defacing your ticket may invalidate it.
A valid ticket Christmas Grotto ticket must be produced by you for each member of your party in order to gain admission to the Westfield Christmas Grotto. Removing any part of, altering or defacing your ticket may invalidate it.
Tickets cannot be resold, exchanged, refunded or transferred.
Westfield will not be responsible for any ticket that is lost, stolen or damaged. It is not always possible to issue replacement tickets. Replacement tickets will therefore be issued at Westfield’s discretion.
   
2    Admission
Your Ice Rink ticket entitles you to admission to the Westfield Ice Rink for one skate session at the time and date stated on your ticket. Each skate sessions is 45 minutes long, including skate change time. Once your allocated skate sessions finishes, you must leave the ice to allow others with a later session time to skate.
Your Christmas Grotto ticket entitles you to admission to the Westfield Christmas Grotto for one ‘grotto event’ at the time and date stated on your ticket. Each session is 60 minutes long. Once your allocated ‘grotto event’ finishes, you must leave the Christmas Grotto to allow others with a later event time to enter.
Westfield reserves the right to refuse admission to the Westfield Ice Rink and the Westfield Christmas Grotto in reasonable circumstances including for health and safety, licensing reasons or where a ticket is invalid for any reason.
Westfield reserves the right to request ticket holders leave the Westfield Ice Rink, Westfield Christmas Grotto or Westfield Shopping Centre at any time and may take appropriate action to enforce this right. For example, Westfield may refuse access to or may remove a ticket holder from the Westfield Ice Rink, Westfield Christmas Grotto or Westfield Shopping Centre who:
(a)    has been convicted of a criminal offence which, in the opinion of Westfield, is likely to affect the safety or enjoyment of other visitors;
(b)    has behaved in a manner which is likely to affect the safety or enjoyment of other visitors;
(c)    has used threatening, abusive or insulting words or behavior or behaves in a manner which may provoke a breach of the peace, or deliberately damages the Westfield Ice Rink, Westfield Christmas Grotto or any part of or property at the Westfield Shopping Centre; or
(d)    in the reasonable opinion of Westfield is acting under the influence of alcohol or drugs.
All ticketholders must adhere to the general rules of use as displayed at the Westfield Ice Rink and Westfield Christmas Grotto respectively.

3    Health and Safety
Westfield may carry out security searches from time to time to ensure the safety of all visitors and you agree to allow yourself and/or your belongings to be searched prior to admittance to the Westfield Ice Rink and/or Westfield Christmas Grotto in order to prevent offensive or dangerous weapons from being taken on to the Westfield Ice Rink and/or Westfield Christmas Grotto.
You will not take any weapons, glass bottles, flammable liquids or any other item that Westfield may consider is dangerous on to the Westfield Ice Rink and/or Westfield Christmas Grotto.
Smoking, eating, drinking and the use of photographic and recording equipment and mobile phones are strictly prohibited on the Westfield Ice Rink and/or Westfield Christmas Grotto for health and safety reasons.
You will comply with all relevant safety announcements and regulations while using the Westfield Ice Rink and/or Westfield Christmas Grotto.
Ice skating is not recommended for women who are, or think that they may be pregnant or for persons who have back, knee or hip issues or any other condition which may be aggravated by falling onto the ice or knocking into the barrier or another skater.

4    Opening Hours and Availability
Westfield reserves the right, in its absolute discretion, whether for safety reasons or otherwise, to close the Westfield Ice Rink and/or Westfield Christmas Grotto. Westfield will where possible give prior notice of such closure.
In the event of such closure Westfield will, via its ticketing agent Wish4Ticket Ltd, refund any booking fee paid by you in respect of tickets valid for times when the Westfield Ice Rink and/or Westfield Christmas Grotto is closed. Westfield shall have no responsibility to you whatsoever, including no liability for travel expenses or any other out of pocket expenses in respect of closure of the Westfield Ice Rink and/or Westfield Christmas Grotto.

5    Recordings

    By using the Westfield Ice Rink and/or Westfield Christmas Grotto you consent to being photographed, filmed or recorded by Westfield. By accepting these Terms and Conditions you agree that Westfield may use such films and recordings in any promotional, advertising or publicity material and without payment or any other further consent.

6    Westfield’s responsibility to you

Other than liability for death or personal injury resulting from Westfield’s negligence, Westfield and its employees or agents shall not be liable for any loss or damage howsoever arising, including without limitation any distress, inconvenience or anxiety caused during the course of any experience and/or during evacuation from the Westfield Ice Rink and/or Westfield Christmas Grotto in the event of closure or accident.

WESTFIELD / 5D GROTTO


1    Photographic permission for 5d grotto experience
All children visiting the grotto will have the opportunity to have their picture and name captured so that they can be part of the grotto 5d experience (“personal grotto content”).

Unless you ask us before entering the grotto not to capture this information, you and/or your child’s picture and name(s) will be recorded and stored by westfield so that we can provide you with your customised momento of your 5d grotto experience. 

Once we have provided you with this, we will delete your personal grotto content.

Remember, if you tell us not to capture your personal grotto content before entering the grotto, you cannot change your mind later if you did want a customised momemto.

2    E-card service data protection terms and conditions

1.    To provide each registrant with the westfield santa e-card service (“e-card”), westfield will collect pictures and other personal information about each registrant and his/her child/children (“personal grotto content”). 

2.    If you do not wish to provide this personal grotto content, please do not register for the  e-card. Children will only feature in the 5d film if personal grotto content is provided.

3.    Contact details for registrants for the e-card will also be added to westfield’s customer database and be used in accordance with our privacy policy.

4.    To view our privacy policy please visit westfield.com/london/information/privacy.

5.    To request contact details to be removed, please send an email to customerrelations@westfield-uk.com or write to the ecrm manager, westfield shoppingtowns limited, 6th floor, midcity place, 71 high holborn, london, wc1v 6ea.

6.    Information will be removed as soon as reasonably possible in accordance with our privacy policy.

3    E-card conduct terms and conditions
1.    To be provided with the westfield santa e-card service (“e-card”) each registrant is required to comply with these conduct terms and conditions.  If you do not wish to comply with them, please do not register for e-card.

2.    You agree that you will be responsible for all uses of e-card made under your registration (and so you should not allow others to use your registration – other people can, of course, register for their own e-card).

3.    We want everyone to be able to enjoy using the e-card experience, so by registering for e-card, you promise that you will follow our ‘e-card house rules’:  

A.    Do think carefully about what you upload and send – so please keep it legal, keep it clean and keep it friendly

B.    Don’t do anything which is defamatory, discriminatory, harrassing or otherwise objectionable
 
C.    Don’t do anything which interferes with the rights of any third party, for example intellectual property rights like copyright or rights of privacy (always make sure the photos you upload are your own or you have proper permission to use them – from the photographer and the people appearing in them)

D.    Don’t pretend to be someone else (famous or otherwise)

E.    Don’t collect information about other e-card service users

F.    Don’t spam people with e-cards or do anything else to annoy or upset any other user of the e-card service

G.    Don’t interfere with or damage any of the technology or content used to provide the e-card service

H.    Don’t use the e-card service for any commercial purpose (for example, to research, advertise, market, promote, sell or otherwise exploit any product, service or person)

4.    You acknowledge that westfield does not monitor any uses of the e-card service and if you notice any conduct which you feel does not comply with these terms and conditions, then please email customerrelations@westfield-uk.com.

5.    Westfield may terminate the accounts of any user who violates these terms and condtions (and stop them registering again).  You also promise to fully compensate us for any loss, damage or costs we suffer because you have breached these terms and conditions (for example, if we get sued because of material which you have uploaded).

6.    You agree that westfield has no responsibility to you in respect of your use of the e-card service other than to use reasonable endeavours to mend the service if it is not working.  Westfield can shut down the e-card service at any time.

4    E-card competition  t+cs
1.    The promoter for the e-card competition is westfield shoppingtowns limited (of 6th floor, midcity place, 71 high holborn london wc1v 6ea) (“westfield”). This promotion is open to all residents of the uk and ireland over the age of 18 except employees of westfield and any affiliated company of westfield, their families, agents and anyone connected with this promotion.

2.    To enter the promotion, entrants must either:

A.    Fully complete the entry form found on the westfield santa e-card web page; or
 
B.    Submit a postal entry containing their telephone number, name, surname, date of birth and email address to: santa ecard promotion, centre management suite, unit 4006, ariel way london w12 7gf and clearly marked ‘westfield santa e-card gift card promotion’ on the outside of the envelope.
   
    (“entry”)

3.    By submitting an entry, entrants consent to their contact details being entered into the westfield customer database and being used in accordance with the westfield privacy policy.  The privacy policy can be found at: westfield.com/london/information/privacy.

4.    One entry per person per week. No purchase necessary.

5.    Entrants have the chance to win one of five westfield £200 gift cards, with a total prize fund of £1,000 worth of westfield gift cards available to win.  Five entrants will each win one £200 gift card. Broadmarsh winners will receive cash or centre voucher as an alternative to the westfield gift card. The product not being available at broadmarsh.

6.    The prize winners shall be selected at random.

7.    The prizes are non-negotiable, non-transferable and non-refundable.

8.    The promotion is from 9am on 18 november 2011 to 9pm on 23 december 2011 ("closing date"). Entries made after the closing date will not be accepted.

9.    Winners will be notified by 3 january 2012 by email to the email address supplied in the entry. If that email address is incorrect or the email bounces back for whatever reason, westfield will call the winner on the telephone number supplied (if any).

10.    Winners will have 14 days to claim their prize by return email, or on the telephone call, as appropriate. Westfield reserves the right to select another winner after the 14 day time period has ended. Each winner is responsible for ensuring they are able to accept the prize in accordance with these terms and conditions.

11.    Each prize will be sent via mail or courier (at westfield’s sole discretion) to the winner’s address as suppplied in the entry.  Delivery will require a signature and id.

12.    Westfield reserves the right at any time to cancel, modify or replace these terms & conditions (including altering prizes) if, in westfield’s sole discretion, the promotion is not capable of being conducted as specified, notice of such will be published on the westfield website.

13.    Any breach of these terms and conditions by entrants will result in the entry being void. Misrepresentative or fraudulent entries will automatically be void.

14.    Westfield's decision is final and no correspondence will be entered into.

15.    Westfield will not be liable for any failure of receipt of entries. Westfield takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. Westfield will not be liable for loss or damage arising out of the winners' enjoyment of their prize.

16.    Entries may not be acknowledged and shall not be returned.
