WESTFIELD MEET SANTA

TICKETING AND LIVESTREAM TERMS & CONDITIONS

1 MEANINGS AND INTRODUCTION

1.1 Please read these terms and conditions (the “Ticketing and Livestream Terms”) carefully as they affect your rights and liabilities.

1.2 Westfield Europe Limited (“Westfield”, “we”, “us” or “our”) sell, allocate and issue tickets (the “Ticket(s)”) and a live stream link (the “Livestream”) for Westfield’s Meet Santa Christmas experience (the “Event”) at Westfield London and Westfield Stratford City shopping centre (each the “Centre”) on these terms and the Event’s terms and conditions of use (the Event terms and conditions of use and these ticketing and livestream terms and conditions, together the “Terms”) published by us from time to time. By purchasing or being issued with Ticket(s) and/or Livestreams, all recipients of Ticket(s) and/or Livestreams (“you”) including the original buyer (the “Buyer”) are deemed to have accepted and agree to adhere to the Terms. Westfield reserves the rights to amend these Terms from time to time.

1.3 The Terms are additional to and not a substitute for the general terms and conditions of use of our website which can be found at https://uk.westfield.com/terms-and-conditions.

1.4 The Ticket(s) and Livestreams are for personal use. You must not auction, donate, offer for sale, or advertise Ticket(s) and/or Livestreams for sale via the internet or elsewhere without our prior written consent.

1.5 A valid Ticket must be booked and produced for each slot at the Event. A child is not permitted to book a Ticket themselves.

1.6 Where selected, a valid Livestream is available for each session at the Event.

1.7 A valid Ticket permits up to 6 people per slot at the Event. There must be at least one adult over the age of 18 present at the booked slot at the Event. Adults are included in the maximum of 6 people per slot.

1.8 A Ticket(s) and Livestream obtained in breach of the Terms, or which in our reasonable opinion is being used or is intended to be used in breach of the Terms, shall be void. This may include you being refused entry to the Event or the Ticket(s) and/or Livestream being cancelled, without notification. No compensation will be provided in such circumstances and we reserve the right to withhold any refund.

1.9 You must not use Ticket(s) and/or Livestreams as prizes in promotions, sweepstakes, hospitality packages, auctions, lotteries or competitions (including those used for charity) without our prior written consent.

2 BOOKING

2.1 This is a ticket only Event. Ticket(s) must be bought or obtained directly from us via our booking platform ‘www.westfieldsanta.com’. We reserve the right to refuse to sell or distribute Ticket(s) and/or Livestream to individuals, companies or agencies who we suspect have breached, or intend to breach, the Terms.

2.2 Each bookable slot will house a maximum of 6 people.

2.3 The Buyer must acknowledge and accept these Terms and any other documentation that forms part of the Ticket booking.

2.4 When you buy Ticket(s) online and confirm your order by pressing the ‘Pay and Book’ button, you are making an offer to us to purchase the Ticket(s) and Livestream on the terms set out in your order. No order will be accepted until we have received full payment in cleared funds following which your Ticket(s) will be booked and you will receive a confirmation of this by email including details of the Livestream if applicable, normally within 24 hours.

2.5 The Buyer is responsible for making sure the information in your order is correct before confirming the order for the Ticket(s). When you have confirmed your order, no details of your booking can be changed other than your personal details. The Ticket(s) and Livestream will only be valid for the time slot, day and Centre stated upon them. You understand that there are only a certain number of Ticket(s) available for each day at the Centre so please ensure that you complete your booking to avoid disappointment.

2.6 For Ticket(s) purchases we accept payment by credit or debit card. All transactions are shown in pounds sterling and include VAT.

2.7 In addition to the price of your Ticket(s) you may be required to pay an international currency exchange fees which may apply. These fees are not refundable in any event.

2.8 Once you have completed your order for the Ticket(s) and Livestream we will not accept any requests for changes to the details of your booking (except in exceptional circumstances where you should contact Customer Service – UK.Ticketing@westfield.com), so please be sure to check the confirmation page carefully before placing your order.

2.9 Westfield does not guarantee the availability of the website or the Event at any time. The prices applicable will be those on the website at the time of ordering (as appearing in your confirmation page) except in the case of manifest error.

3 DELIVERY AND COLLECTION

3.1 Upon booking your Ticket(s) and Livestream and receiving the order confirmation, your Ticket(s) and details of the Livestream will be emailed to you. You will also be able to manage the details of you booking using the links provided in the email. At the Event the Buyer must present the confirmation email as identification. Other identification may not be accepted and the Ticket(s) may be withheld.

3.2 Always check your Ticket(s) upon receipt and let us know if there are any errors. Mistakes made when ordering cannot always be corrected and any corrections are discretionary.

3.3 On the day of your visit to the Event you should check that the Centre and the Event are open and check the allocated start time.

4 REPLACEMENT TICKETS

4.1 Westfield is not responsible for any lost, stolen or damaged Ticket(s) or lost or corrupted Livestream links. Any replacement of lost, damaged or stolen Ticket(s) or lost or corrupted Livestream links is at our discretion and we may charge an administration charge for the replacement.

5 REFUND POLICY

5.1 We do not refund Ticket(s) or Livestreams except in certain circumstances.

5.2 Requests to cancel Ticket(s) and Livestreams must be made no later than 24 hours before your booked attendance slot. If you wish to cancel please send an application for a refund as described below.

5.3 If the Event is closed for any reason for the whole of the time slot during which your Ticket(s) and Livestream is valid, then the original Buyer of the Ticket(s) and Livestream will be refunded with the amount that they paid for the Ticket(s). The maximum refund payable will be the face value of the Ticket(s). Westfield will not be responsible in any circumstances for any travel costs incurred.

5.4 Only the original Buyer of the Ticket(s) and Livestream is eligible for refunds.

5.5 Non-attendees will not be eligible for refunds unless they have cancelled their Ticket(s) and Livestream in advance as described in paragraph 5.2 above. Wherever possible, refunds will be made to the original payment method (i.e. direct to credit / debit card account). Save as described in paragraph 5.2 above, applications for refunds will only be accepted if received within 28 days of the date on the Ticket.

5.6 Any applications for refunds should be sent to Customer Service - UK.Ticketing@westfield.com. Each application for a refund must state your booking reference, name of the original Buyer (and the email address registered with your booking) and the reason for your application.

6 HEALTH AND SAFETY

6.1 Westfield may carry out security searches from time to time to ensure the safety or all visitors and you agree to allow yourself and/or your belongings to be searched prior to admittance to the Event in order to prevent offensive or dangerous weapons from being taken to the Event and the Centre.

6.2 You may not take any weapons, glass bottles, flammable liquids or any other item that Westfield in its sole discretion may consider is dangerous to the Event and the Centre.

6.3 Smoking, eating, and the use of photographic and recording equipment and mobile phones are strictly prohibited in the Event for health and safety reasons.

6.4 You will comply will all relevant safety announcements and regulations while attending the Event including but not limited to:

6.4.1 Use the hand sanitation stations upon entry to the Event at the Centres;

6.4.2 Follow and adhere to the one-way system in place at the Event;

6.4.3 Adhere to all social distancing measures in place at the Event; and

6.4.4 Keep one metre apart where possible.

6.5 If you or any member of your party is experiencing any Covid-19 symptoms as published by the government from time to time or have been told to self-isolate, you should not attend the Event or Centre under any circumstances.

7 LIMITATION OF LIABILITY

7.1 Whilst Westfield makes every effort to monitor the Event fulfilled by the suppliers of the Event (“Event Suppliers”), any liability incurred by you, the Buyer or visitor caused by the Event Supplier’s negligence is the responsibility of the Event Supplier and not the responsibility of Westfield. Westfield shall not be liable for the death or personal injury of you, the Buyer or the visitor or third party while attending the Event provided by the Event Supplier. Westfield shall have no liability for damage to property, consequential loss or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses, resulting in third party claims. You waive all rights of whatsoever nature against Westfield and the Centre owner and each of their employees, servants, agents, independent contractors or representatives in respect of injury, death, loss or damage arising from your attendance at the Event.

7.2 Nothing in these terms and conditions affects your statutory rights.

7.3 Westfield shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to delivery charges, custom or duty tax, travel expenses and car parking fees and/or any other out of pocket expenses.

7.4 Westfield does not accept responsibility for (i) network, computer, hardware or software failures of any kind which may restrict or delay the purchase or delivery of items, or (ii) any act or default of any third party supplier which is outside of Westfield’s reasonable control.

7.5 Except as set out in paragraph 7.1 above, nothing in the Terms shall exclude or restrict Westfield’s or the Centre owner’s liability for death or personal injury caused by its negligence or the negligence of its officers or employees or for any fraudulent misrepresentation.

8 IN GENERAL

8.1 Any discounts, vouchers or lower priced Ticket(s) must be mentioned when you buy Ticket(s) and cannot be applied for in retrospect. Where a discount, voucher or lower price is claimed, proof of identity and entitlement may be required.

8.2 Possession of a Ticket and/or link to a Livestream does not confer any rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the trade marks, logos and/or intellectual property appearing on the Ticket(s) and/or Livestream.

8.3 We reserve the right to change the advertised dates, opening hours and schedule of the Event without notice or liability, where it is necessary to do so for reasons beyond our reasonable control. We may close or remove parts of the Event if deemed faulty or unsafe. These Terms set out your rights in this situation.

8.4 We reserve the right to refuse admission to the Event in reasonable circumstances including for health and safety reasons, licensing reasons, inappropriate behaviour or where a Ticket(s) and/or Livestream is invalid for any reason. We reserve the right to request that you leave the Event and/or Centre at any time in our absolute discretion.

8.5 Save that any company in the Westfield group of companies, as well as the Centre owners, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

8.6 Nothing in these Terms affects any of your statutory rights which may not be legally excluded.

8.7 Enforcement of these Terms is solely at our discretion, and just because we may not enforce them in some circumstances does not mean that we have lost the right to enforce in future.

8.8 These Terms of Use shall be governed by and interpreted in accordance with the laws of England and any disputes will be decided only by the English courts.

9 HOW WE USE YOUR PERSONAL DATA

9.1 By purchasing a Ticket and/or attending the Event with a Ticket and/or via Livestream, you are sending your personal information to Westfield who will use this personal data in accordance with data protection laws and our privacy notice (https://uk.westfield.com/privacy). This notice explains how Westfield processes your personal data, your rights, and how you can contact us. Westfield’s data protection team can be contacted at DPO@urw.com. Because Westfield is a UK company, Buyer’s personal information needs to be stored in or transferred to the UK or be accessed from the UK.

9.2 You will also be providing personal data to our platform provider ‘Innovate Live Ltd’, and will be processed in accordance with their privacy notice.

9.3 Where you have consented to receiving marketing materials from our platform provider Innovate Live Ltd, you understand that your personal data will be treated in accordance with the Innovate Live Ltd’s privacy notice (not Westfield’s) and that it is Innovate Live Ltd’ who is responsible for ensuring that your personal data is treated in accordance with data protection laws. Should you have any queries or complaints in relation to Innovate Live Ltd’s treatment of your personal data, you should refer that complaint directly to Innovate Live Ltd.

EVENT TERMS & CONDITIONS

1. INTRODUCTION

1.1. Please read these Terms and Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Westfield Europe Limited (“Westfield”) makes the Westfield Meet Santa 2021 event (the “Event”) available for use.

1.2. By purchasing or being issued tickets for the Event (the “Ticket(s)”) or being issued with a live stream link for the Event (the “Livestream”) you are deemed to have accepted and agree to adhere to these Event Terms and Conditions and the Meet Santa 2021 Ticketing Terms (these Terms and Conditions and the Meet Santa 2021 Ticketing Terms, together the “Terms”). Westfield reserves the rights to amend these Terms from time to time.

2. TICKETS AND ADMISSION

2.1. All Tickets and Livestreams are issued subject to availability and these Terms.

2.2. You must not auction, donate, offer for sale, loan or advertise your Tickets and/or Livestreams or sale via the internet or elsewhere.

2.3. A valid Ticket must be produced for each session at the Event.

2.4. Where selected, a valid Livestream is available for each session at the Event.

2.5. All children aged under 18 years old must be accompanied by an adult who has purchased a Ticket.

2.6. Your Ticket entitles you to admission to the Event for one session at the time and date stated on your Ticket.

2.7. Each Ticket and Livestream session is a maximum of 10 minutes long.

2.8. Once your allocated Ticket session finishes, you must leave the Event to allow others with a later event time to enter.

2.9. Once your allocated Livestream finishes, you must leave the Livestream.

2.10. You must not record or copy the Livestream.

2.11. Westfield will use reasonable endeavours to provide a suitable gift for each child under the age of 12 years old who attends the Event (the “Event Gift”). The Event Gift is subject to availability and must be accepted as offered, is non-transferable and cannot be exchanged (for cash or otherwise).

2.12. Westfield reserves the right to refuse admission to the Event including for health and safety, licensing reasons or where a Ticket and/or Livestream is invalid for any reason.

2.13. A Ticket(s) and/or Livestream obtained in breach of the Terms, or which in our reasonable opinion is being used or is intended to be used in breach of the Terms, shall be void. This may include you being refused entry to the Event or your Ticket(s) 4and Livestream being cancelled without notification. No compensation will be provided in such circumstances.

2.14. All ticketholders must adhere to the general rules of use as displayed at the Event.

2.15. Westfield reserves the right to request Ticket holders to leave the Event or Westfield shopping centre at any time and may take appropriate action to enforce this right. Westfield may refuse access to or may remove a Ticket holder from the Event or Westfield shopping centre who:

(a) has been convicted of a criminal offence which, in the opinion of Westfield, is likely to affect the safety or enjoyment of other visitors;

(b) has behaved in a manner which is likely to affect the safety or enjoyment of other visitors;

(c) has used threatening, abusive or insulting words or behavior or behaves in a manner which may provoke a breach of the peace, or deliberately damages the Event or any part of or property at the Westfield shopping centre; or

(d) in the reasonable opinion of Westfield is acting under the influence of alcohol or drugs.

3. HEALTH AND SAFETY

3.1. 3.2. You will not take any weapons, glass bottles, flammable liquids or any other item that Westfield may consider is dangerous in to the Event and Westfield shopping centre.

3.3. Smoking, eating, drinking and the use of photographic and recording equipment and mobile phones are strictly prohibited in the Event for health and safety reasons.

3.4. You will comply with all relevant safety announcements and regulations while attending the Event.

3.5. You will comply will all relevant safety announcements and regulations while attending the Event including but not limited to:

3.5.1. Use the hand sanitation stations upon entry to the Event at the shopping centre;

3.5.2. Follow and adhere to the one-way system in place at the Event;

3.5.3. Adhere to all social distancing measures in place at the Event; and

3.5.4. Keep one metre apart where possible.

3.5.5. All attendees eleven years of age and over shall always wear a face covering whilst at the Event and in the shopping centre. 

3.5.6. Santa will not be wearing a mask during this Event. If you require Santa to wear a mask or visor please let us know in advance of your visit. Westfield reserve the right to change the policy at any time. 

3.6. If you or any member of your party is experiencing any Covid-19 symptoms as published by the government from time to time or have been told to self-isolate, you should not attend the Event or the shopping centre under any circumstances.

4.2. Due to the nature of some of the experiences offered by the Event Supplier including the sampling of foods, certain foods may be harmful to your health. Therefore, as a Participant, or you as a parent or guardian must notify the restaurant of any medical conditions or allergens before dining. It is suggested that any requirements are also highlighted upon arrival.

4.3. Nothing in these terms and conditions affects your statutory rights.

5. OPENING HOURS AND AVAILABILITY

5.1. Westfield reserves the right, in its absolute discretion, whether for safety reasons or otherwise, to close the Event.

5.2. Westfield will, where possible, give prior notice of such closure.

5.3. Westfield reserves the right to change the advertised dates, opening hours and schedule of the Event without notice or liability, where it is necessary to do so for reasons beyond our reasonable control. We may close or remove a session at the Event if deemed faulty or unsafe. These Terms set out your rights in this situation.

5.4. In the event of such closure Westfield will provide a refund in accordance with the refund policy set out in the Event Ticketing Terms and Conditions.

6. GENERAL

6.1. Attendance at the Event does not confer any rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the trade marks, logos and/or intellectual property appearing on the Event website.

6.2. We reserve the right to change the Terms from time to time.

6.3. Westfield reserves the right to cancel the Event.

6.4. Save that any company in the Westfield group of companies, as well as the shopping centre owners, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.
