TICKETING

1. INTRODUCTION

1.Please read these Terms and Conditions (the “Terms”) carefully as they affect your rights and liabilities under the law and set out the terms under which Westfield Europe Limited (“Westfield”, “we” or “our”) makes available for use the Westfield  Wish Upon a Star Santa experience (the “Experience”),

(the Experience followed by meeting with Santa make the “Event”).

2. By booking or being issued tickets for the Event (the “Ticket(s)”) you are deemed to have accepted and agree to adhere to these Terms. Westfield reserves the rights to amend these Terms from time to time. 

3. These Terms are additional to and not a substitute for the general terms and conditions of use of our website which can be found at https://uk.westfield.com/terms-and-conditions.

2. TICKETS AND ADMISSION

1. All Tickets are free of charge and are issued subject to availability and these Terms.  

2. You must not auction, donate, offer for sale, loan or advertise your Tickets or sale via the internet or elsewhere. 

3. Each Ticket is issued for one session of the Event and each session lasts for a maximum of 10 minutes (each, a “Session”).

4. A valid Ticket must be produced for each Session.  

5. The Experience is suitable for children of all ages. There are some activities within the Experience that are suitable for aged 4 years - 12 years old children.

6. Each child (including babies) requires a Ticket for the Experience.

7. Maximum of 4 children per booking. Minimum of 1 adult per booking (Maximum group size for adults and children: 6 people).

8. You (including any children included in your booking) may only participate in one Session for the duration of the Event set out in Clause 8.2. 

9. If you are unable to attend a Session at the date and time on your Ticket, where possible, please cancel the Ticket(s) so the Session(s) can be reallocated. We cannot guarantee an alternative Session.

10. Once your allocated Session finishes, you must leave the Event to allow others with a later Session time to enter.  

11. Westfield reserves the right to refuse admission to the Event for any reason including for health and safety, licensing reasons or where a Ticket is invalid for any reason. 

12. A Ticket obtained in breach of these Terms, or which in our reasonable opinion is being used or is intended to be used in breach of these Terms, shall be void.  This may include you being refused entry to the Event or your Ticket(s) being cancelled without notification. No compensation will be provided to you in such circumstances.  

13. All Ticket holders must adhere to the general rules of use as displayed at the Event from time to time. 

14. Westfield reserves the right to request Ticket holders to leave the Event or Westfield shopping centre at any time and may take appropriate action to enforce this right. Westfield may refuse access to a Ticket holder or may remove a Ticket holder from the Event or Westfield shopping centre if such person: 

(a) has been convicted of a criminal offence which, in the opinion of Westfield, is likely to affect the safety or enjoyment of other visitors;

(b) has behaved in a manner which is likely to affect the safety or enjoyment of other visitors;

(c) has used threatening, abusive or insulting words or behavior or behaves in a manner which may provoke a breach of the peace, or deliberately damages the Event or any part of or property at the Westfield shopping centre; or

(d) in the reasonable opinion of Westfield is acting under the influence of alcohol or drugs.

3. HEALTH AND SAFETY

1. Westfield may carry out security searches from time to time to ensure the safety of all visitors and you agree to allow yourself and/or your belongings to be searched prior to admittance to the Event in order to prevent offensive or dangerous weapons from being taken in to the Event or Westfield shopping centre. 

2. You will not take any weapons, glass bottles, flammable liquids or any other item that Westfield may consider is dangerous in to the Event and Westfield shopping centre. 

3. Smoking is strictly prohibited in the Event for health and safety reasons. 

4. You will comply with all relevant safety announcements and regulations while attending the Event.

5. If you or any member of your party is experiencing any Covid-19 symptoms as published by the government from time to time, have tested positive for Covid-19, or have been told to self-isolate, you should not attend the Event or the Westfield shopping centre under any circumstances.  

4. LIMITATION OF LIABILITY

1. Whilst Westfield makes every effort to monitor those aspects of the Event which are fulfilled by third party suppliers of the Event (“Event Suppliers”), any liability incurred by you which is caused by the acts or omissions of Event Suppliers is the responsibility of the Event Supplier and not the responsibility of Westfield.  Westfield shall not be liable for the death of or personal injury to any Event attendees which arises from or is caused by events outside of Westfield’s reasonable control including the acts or omissions of the Event Suppliers.  Westfield shall have no liability for damage to property, consequential loss or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses, resulting in third party claims. You waive all rights of whatsoever nature against Westfield and the Westfield shopping centre owner and each of their employees, servants, agents, independent contractors or representatives in respect of injury, death, loss or damage arising from your attendance at the Event which is caused by the acts or omissions of the Event Suppliers

2. Westfield shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to delivery charges, custom or duty tax, travel expenses and car parking fees and/or any other out of pocket expenses.

3. Westfield does not accept responsibility for any act, omission or default of any third party supplier (including Event Suppliers) which is outside of Westfield’s reasonable control. 

4. Except as set out in Clause 4.1 above, nothing in these Terms shall exclude or restrict Westfield’s or the Westfield shopping centre owner’s liability for death or personal injury caused by its negligence or the negligence of its officers or employees or for any fraudulent misrepresentation.

5. OPENING HOURS AND AVAILABILITY

1. Westfield reserves the right, in its absolute discretion, whether for safety reasons or otherwise, to close the Event at any time.   

2. Westfield will, where possible, give prior notice of such closure.  

3. Westfield reserves the right to change the advertised dates, opening hours and schedule of the Event without notice or liability, where it is necessary to do so for reasons beyond our reasonable control. We may close or remove a session at the Event if deemed faulty or unsafe. These Terms set out your rights in this situation.

4. In the event of such closure, Tickets issued for the Event are non-transferable.

6. GENERAL

1. Attendance at the Event does not confer any rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the trade marks, logos and/or intellectual property appearing on the Event website. 

2. We reserve the right to change these Terms from time to time.  

3. Westfield reserves the right to cancel the Event at any time and without penalty.  

4. Save that any company in the Westfield group of companies, as well as the Westfield shopping centre owners, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. 

5. Nothing in these Terms affects any of your statutory rights which may not be legally excluded.  

6. Enforcement of these Terms is solely at our discretion, and just because we may not enforce them in some circumstances does not mean that we have lost the right to enforce in future. 

7. HOW WE USE YOUR PERSONAL DATA

1. By attending the Event, you may send personal data to Westfield who will use this personal data in accordance with applicable data protection laws and our privacy notice (https://uk.westfield.com/privacy). This privacy notice explains how Westfield processes your personal data, your rights in relation to that personal data, and how you can contact us. Westfield’s data protection team can be contacted at DPO@urw.com. As Westfield is a UK company, your personal data needs to be stored in or transferred to the UK or be accessed from the UK. 

8. EVENT DETAILS

1. The meeting with Santa will take place following the Experience.

2. Subject to Clause 5, the Event will take place on the following dates in December 2023: 8th, 9th, 10th, 11th, 12th, 13th, 14th, 15th, 16th, 17th, 18th, 19th, 20th, 21st, 22nd, 23rd, and 24th.

3. The Sessions will take place at the following times:

3.1 between 8th December – 14th December, the Sessions will run from 10:00-18:00;

3.2 between 15th December – 23rd December, the Sessions will run from 10:00-19:00; and

3.3 on 24th December, the Sessions will run from 10:00-18:00.

4. The Event will take place on the dates listed in Clause 8.2 above both i) on the ground floor next to Mark & Spencer at Westfield London shopping centre (Ariel Way, London W12 7GF) and ii) in the Arena at Westfield Stratford City shopping centre (Montfichet Rd, London E20 1EJ).

5. Tickets will be available to book via Eventbrite from a date to be disclosed by Westfield.

6. A Ticket for the Event will include:

 

6.1 Access to the Event; and

6.2 Westfield will use reasonable endeavours to provide a suitable gift for each child under the age of 12 years old who attends the Event (the “Event Gift”). The Event Gift is subject to availability and must be accepted as offered, is non-transferable and cannot be exchanged (for cash or otherwise).

EVENT

 

1. INTRODUCTION

 

1. Please read these Terms and Conditions (the “Terms”) carefully as they affect your rights and liabilities under the law and set out the terms under which Westfield Europe Limited (“Westfield”, “we” or “our”) makes the Westfield Meet Santa 2023 event as is described in more detail Clause 8 below (the “Event”) available for use. 

 

2. By participating in the Event you are deemed to have accepted and agree to adhere to these Terms. Westfield reserves the rights to amend these Terms from time to time.

2. ADMISSION

 

1. Admission to the Event is subject to availability and these Terms.

 

2. All children aged under 18 years old who attend the Event must be accompanied by an adult.

 

3. Admission to the Event is for one session which lasts for a maximum of 10 minutes (each, a “Session”) at the time and on the date you have queued for the Event.

 

4. Once your allocated Session finishes, you must leave the Event to allow others to enter. 

 

5. Westfield will use reasonable endeavours to provide a suitable gift for each child under the age of 12 years old who attends the Event (the “Event Gift”). The Event Gift is subject to availability and must be accepted as offered, is non-transferable and cannot be exchanged (for cash or otherwise). 

 

6. Westfield reserves the right to refuse admission to the Event for any reason including for health and safety, licensing reasons or for any other reason.

 

7. Westfield reserves the right to close the Event up to one hour before the advertised closing time (set out in Clause 8 below) when queues are at maximum capacity to ensure the  Event closes on time.

 

8. If you are in breach of these Terms, or in our reasonable opinion you are or intended to breach of these Terms, admission to the Event will not be allowed.  This may include you being refused entry to the Event or your admission being cancelled without notification. No compensation will be provided to you in such circumstances.

 

9. Westfield reserves the right to request attendees to leave the Event or Westfield shopping centre at any time and may take appropriate action to enforce this right. Westfield may refuse any person access to or may remove any person from the Event or Westfield shopping centre who:

 

(a) has been convicted of a criminal offence which, in the opinion of Westfield, is likely to affect the safety or enjoyment of other visitors;

 

(b) has behaved in a manner which is likely to affect the safety or enjoyment of other visitors;

 

(c) has used threatening, abusive or insulting words or behavior or behaves in a manner which may provoke a breach of the peace, or deliberately damages the Event or any part of or property at the Westfield shopping centre; or

 

(d) in the reasonable opinion of Westfield is acting under the influence of alcohol or drugs.

 

 

3. HEALTH AND SAFETY

 

1. 3. Smoking, eating, drinking and the use of photographic and recording equipment and mobile phones are strictly prohibited in the Event for health and safety reasons.

 

4. You will comply with all relevant safety announcements and regulations while attending the Event.

 

5. Santa will not be wearing a mask during the Event. If you require Santa to wear a mask or visor please let us know in advance of your visit. Westfield reserves the right to determine at any time that Santa shall wear a mask for reasons related to Covid-19.

 

6. If you or any member of your party is experiencing any Covid-19 symptoms as published by the government from time to time, have tested positive for Covid-19, or have been told to self-isolate, you should not attend the Event or the Westfield shopping centre under any circumstances. 

 

 

4. LIMITATION OF LIABILITY

 

1. 2. The Event Gift may be a food item. Therefore, as a Participant of the Event, or you as a parent or guardian of a child Event attendee, you must notify Westfield of any medical conditions or allergens before accepting the Event Gift. It is suggested that any such requirements are also highlighted upon arrival at the Event or the Westfield shopping centre.  Westfield shall not be liable for any injury caused to an Event attendee as a result of an Event attendee’s consumption of an Event Gift, if such injury is caused by any medical condition or allergen which Westfield was not made aware of in advance.

 

3. Westfield shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to delivery charges, custom or duty tax, travel expenses and car parking fees and/or any other out of pocket expenses.
